Mental Capacity Act 2005

The Mental Capacity Act 2005 has already been heralded as introducing a new regime in respect of issues affecting people who lack mental capacity to make decisions, including those who are presently competent but might lack capacity in the future.

The Act will have implications for many people, including healthcare professionals, care homes, carers and patients.  It is due to implemented in April 2007 and all organisations in the healthcare sector will need to understand the new legal processes introduced by the Act and put policies in place in order to comply with the legislation.

RadcliffesLeBrasseur have already provided seminars to a number of healthcare providers, particularly those in the mental health sector.

The Government announced in June that it has decided to make amendments to the Act in order to plug the “Bournewood gap”.  Accordingly, this will have added significance for the legislation and will make it all the more important that those in the mental health sector are fully aware of the implications of the legislation before it comes into force.
